The California Court of Appeal on September 26 approved a police officer's rifling through the cell phone belonging to someone who had just been pulled over for a traffic violation. ? Reid Nottoli was pulled over on December 6, 2009 just before 2am as he was taking a female friend home. Santa Cruz County Deputy Sheriff Steven Ryan said Nottoli's silver Acura TL had been speeding on Highway 1. After speaking with Nottoli on the side of the road, Ryan suspected the 25-year-old was under the influence of a stimulant drug. His license was also expired, so Ryan said he would impound the vehicle. Nottoli asked if his car could stay parked on the side of the road, which was not heavily traveled and out of the way. Ryan refused so that he could conduct an "inventory" search prior to the towing. ? Ryan testified that Nottoli's driving was not impaired, and Nottoli was not arrested for driving under the influence. As he rifled through the belongings in the car, Ryan found a fully legal Glock 20 pistol with a Guncrafter Industries 50 GI conversion that should have been stored in the trunk of the vehicle. He also noticed Nottoli's Blackberry Curve which, after it was turned on, displayed a photograph of a mask-wearing man holding two AR-15 rifles akimbo. Such rifles could have been legally possessed if owned before California's assault weapons ban took effect. The photograph could also have been taken in another state, but Ryan took it was evidence of possible "gun-related crimes." ? Another deputy began reading all of Nottoli's cell phone text messages, photographs and emails. Much later, Ryan obtained a search warrant to grab more information from the phone, and then a second search warrant was obtained for Nottoli's home. Based on the information from the Blackberry, the Santa Cruz County Sheriff's Office SWAT team on December 16 raided the Nottoli home. They found a large cache of weapons, a marijuana growing operation and $15,000 in cash, which the law enforcement officials kept. ? At trial, Nottoli argued the cell phone search was illegal, and a magistrate agreed to suppress the evidence as obtained in violation of the Fourth Amendment. The appellate court, however, only agreed that the phone search was unlawful as part of the inventory process for the automobile. The judges insisted that the search was valid as part of the arrest process in which no warrant is needed to examine items related to officer safety and the preservation of evidence, as expanded by the 2009 US Supreme Court ruling in Arizona v. Gant (view ruling). ? "In sum, it is our conclusion that, after Reid [Nottoli] was arrested for being under the influence, it was reasonable to believe that evidence relevant to that offense might be found in his vehicle," Justice Franklin D. Elia wrote for the three-judge panel. "Consequently, the deputies had unqualified authority under Gant to search the passenger compartment of the vehicle and any container found therein, including Reid's cell phone. It is up to the US Supreme Court to impose any greater limits on officers' authority to search incident to arrest." ? The court reversed the lower court's order suppressing the evidence, but the decision was made solely to set legal precedent. Reid Nottoli died on September 4. IDENTIFICATION: During a BBQ, a woman stumbled and took a little fall - she assured everyone that she was fine (they offered to call paramedics) ...she said she had just tripped over a brick because of her new shoes. They got her cleaned up and got her a new plate of food. While she appeared a bit shaken up, Jane went about enjoying herself the rest of the evening. Jane's husband called later telling everyone that his wife had been taken to the hospital - (at 6:00 PM Jane passed away.) She had suffered a stroke at the BBQ. Had they known how to identify the signs of a stroke, perhaps Jane would be with us today. Some don't die. They end up in a helpless, hopeless condition instead. It only takes a minute to read this. A neurologist says that if he can get to a stroke victim within 3 hours he can totally reverse the effects of a stroke...totally. He said the trick was getting a stroke recognized, diagnosed, and then getting the patient medically cared for within 3 hours, which is tough.? RECOGNIZING A STROKE Thank God for the sense to remember the '3' steps, STR. Read and Learn! Sometimes symptoms of a stroke are difficult to identify. Unfortunately, the lack of awareness spells disaster. The stroke victim may suffer severe brain damage when people nearby fail to recognize the symptoms of a stroke. Now doctors say a? bystander can recognize a stroke by asking three simple questions: S? *Ask the individual to SMILE. T? *Ask the person to TALK and SPEAK A SIMPLE SENTENCE? (Coherently) (I.e. The purpose of the meeting was to engage in a dialog and get a status update regarding the Draft Environmental Impact Study (DEIS). ??????????? According to a USMC spokesperson, the final base expansion EIS is scheduled for release in January 2012. A response to previously received public comments will be included in the Final EIS. Barring any significant challenges or related delays, the Final Record of Decision is expected by April 2012. From there, the EIS will be submitted to the U.S. Department of the Interior and then it must be submitted to, and approved by, Congress. The federally funded campaign, "Look Twice, Save a Life," was designed to increase drivers' awareness of motorcyclists on the road. ??????????? Preliminary 2010 CHP statistics show the number of people killed in motorcycle-involved collisions was down 9 percent from the previous year. The number of injuries was down 8.5 percent. ??????????? The campaign focused on educating car and truck drivers about how difficult it is to see motorcyclists. We just need to stay there as short a time as possible, and when we are temporarily IN someone?s Blind Area, we need to be aware of it and be ready to move OUT of that space on a half-seconds notice if a driver appears ready to move towards you.? ? ?Today?s cars are being built so tight and soundproof, and have such powerful audio systems, ?that the drivers of many of them are not able to hear a motorcycle horn.? When you are approaching an intersection, if you are following another vehicle too closely in their right-track,? you are just about totally invisible to vehicles coming from the opposite direction ?.especially vehicles that are waiting to turn left?.They can?t see you, and they think that you are just an empty space into which they can complete their left turn.? Be Ready !? Any intersection is a ?Bad Neighborhood? and is filled with Blind Spots !? The safer place to ride is any place where you can see.... and where you can be seen. ? An S.U.V. or large Pickup has more blind spots than smaller cars.? The problems occur when someone who has been driving a small auto for most of their lives, now gets into one of these big status symbols and doesn?t realize that along with taller and higher and wider comes a GREAT increase in Blind Spots !!? They can?t see us approaching as well,? and totally lose sight of us when we get close.? The right-rear wheel area of an SUV or Pickup is an especially high target area. ? Congressman James Sensenbrenner (R-WI) has introduced HR 3199, a bill that would require the Environmental Protection Agency (EPA) to seek independent scientific analysis on the affects of 15-percent ethanol blend gasoline.? The bill would not overturn the option for ethanol to continue to be sold, it simply asks for more study on the use of an E15 blend; something the Motorcycle Riders Foundation (MRF) has been asking for as well.? "The EPA's decision to allow E15 into the marketplace will impact every American who owns a car, lawnmower, or boat.? Automakers insist that using E15 will void warranties, lower fuel efficiency, and cause premature engine failure. In off-road engines, the effects can even be dangerous for users," Sensenbrenner said.? "There are serious concerns that the EPA used only one Department of Energy test and rushed E15's introduction into the marketplace. This test was limited in scope and ignored a plethora of evidence ? albeit inconvenient evidence for the EPA ? that shows E15 gasoline has a negative effect on engines.?? Sensenbrenner is very serious about this issue. He conducted his own study by questioning 14 automakers about the effect of an E15 blend on their products. The unanimous consent was grim. Everybody agreed that E15 would void warranties, damage engines and lower fuel efficiency. ? The MRF requests that you contact your Representative in the United States House of Representatives and ask them to cosponsor HR 3199, the Sensenbrenner EPA E15 study bill. ? NTSB WANTS MEDIAN IMPROVEMENTS? A recently released set of recommendations by the National Transportation Safety Board (NTSB) includes one that specifically addresses cable barriers.? The NTSB asks that the Federal Highway Administration (FHWA) work with the States to define the criteria regarding where cable barriers are placed, and to research the safety risks associated with cable barriers. ? Holtsclaw, a Houston, Texas police officer for almost thirty-two years, was recently forced to retire because of his insistence on enforcing ordinances restricting obnoxious motorcycle noise.? Officer Holtsclaw faced pressure within the Houston police department and from pro-noise motorcyclists to stop enforcing the law.? Officer Holtsclaw received little or no support from elected officials in Houston.? Holtsclaw decided to start issuing tickets to what he perceived as ?loud motorcycles?. After a few months of writing tickets caught the attention of his commanding Patrol Sergeant who ordered him to cease issuing those kinds of tickets. He explained that the law is so vague that it is unenforceable. However, Holtsclaw broke orders and continued on his mission to silence Houston.? According to Holtsclaw it was the upper levels of the Houston Police Department, Mayor Annise Parker, Houston's City Council, and Houston's Legal Department that forced him into retirement. ? It would be nice if we could depend on a clear road, but the good rider knows there are more possible hazards along the open highway than space invaders in a video game ! ????? ?Deer are the most common animal hazard and the most unpredictable. ?The months of October, November, and December, is the period that motorists are most at risk of colliding with these animals that have no innate sense of avoiding other moving objects. ? Drivers would do well to be on high alert during this year-end period. The National Motorist Association reported last that deer-vehicle collisions increased by 20 percent during the preceding five years, even though vehicle miles driven across the U.S. only went up 2 percent during the same period. ?Deer will stare at you as you approach and then leap into the road as you reach them.? Every year there are well over a hundred-thousand reported collisions with deer, resulting in the loss of more than a hundred human lives. ? Be extra alert when visibility us at a low,? in areas where trees come up close to the road,? and where there are posted deer-warning signs.? There is controversy regarding whether deer can hear those little plastic deer-whistles that you can mount on your vehicle.? If you see two deer cross the road, expect a third?.If you see three,? expect a fourth. ????? ?Animals don?t wear reflectors at night and can be closer than a hundred feet away when your headlights pick them up.? Even at 40 MPH you need more than 100 feet to stop, so swerve around them if you can, but not at the risk of driving into oncoming traffic or into a big Oak tree.? Secondary state highways often resemble petting zoo?s for all the animals we find out there.? Larger animals may not be as common as deer but can be a lot more deadly.? Moose and horses can weigh up to a thousand pounds, and are taller than your bike.? A cow on the road can make a massive blockade if you are overdriving your visibility.? A ?cow? warning sign or steel pipes built into the road (or vertical paint stripes) indicate an Open Range Area where the cows are not fenced in.? Many drivers have struck dogs and then were badly bitten when they tried to comfort or move the animal. ????? Our fellow two-legged critters should know better, but often require as much care and caution as four-legged road hazards.? You can expect almost anything in your lane, right around that next bend in the road including a stopped car with the driver taking pictures of the deer that just crossed the road, a flock of joggers, or a herd of bicyclists. ?It?s best that they be made aware of the fact you are approaching, with a tap on your horn, so they don?t swerve out to avoid a pothole or puddle.? Many states require this by law,? but prohibit using a horn when approaching a horseback rider. ? Whose road is it anyway ?? No matter how many wheels or feet the other road users have, and no matter where they pop up from, the good rider will expect the worst and do the best at avoiding hazards.?
